Terms and Conditions

Please read the terms carefully, then scroll to the bottom of the page to fill in and confirm the agreement.

These Terms and Conditions apply to the purchase of services by you (the Customer or "you"). I, Monika Bettney, trading as MB Dietetics, with the email address hello@mbdietetics.com (referred to as "us" or "we"), provide the services under the terms set forth below.

Services

The description of the services, referred to as programmes or appointments, is as outlined on the Website (www.mbdietetics.com). For services tailored to your specific requirements, it is your responsibility to provide accurate information or specifications.

Customer Obligations

  1. Co-operation and Accuracy
    You must co-operate fully in all matters related to dietetic consultations, including providing accurate and up-to-date information about your diet, lifestyle, medications, supplements, and medical history during written and verbal assessments.

  2. Appointment Rescheduling
    If you need to reschedule an appointment, you must notify us at least 24 hours in advance.

  3. Intellectual Property
    Any resources provided by MB Dietetics are protected by copyright laws. You may not share, distribute, or reproduce these materials without our written permission.

Personal Information

We retain and use all personal information in strict accordance with our Privacy Policy. By purchasing a programme or appointment, you agree that we may contact you via email or other electronic communication methods. If you wish to use encrypted options for information exchange, please let us know in writing.

Basis of Sale

  1. Any quotation or estimate of fees is valid for 15 days, unless withdrawn earlier.
  2. A contract for an MB Dietetics programme or appointment is formed only when the required payment has been made.

Fees and Payment

Fees for services are as listed on the Website (www.mbdietetics.com). Additional services requested will be priced on either a fixed fee or a standard daily rate basis.

Late Payment Charges

  1. Invoices must be paid by the due date stated on the invoice.
  2. Any late payments will incur a charge of £10 per day from the day after the payment due date until full payment is received.
  3. If we need to issue a reminder to you regarding an unpaid invoice, an additional £25 administrative fee will be applied to cover our costs for each reminder issued.

Delivery of Services

  1. Services will be delivered as per the programme or appointment schedule. Any changes to the schedule will be communicated with at least 24 hours' notice.
  2. If services are not delivered due to events beyond our control, you may request a reduction in fees, up to the full amount if no services were provided.
  3. Appointments can be rescheduled once, provided we receive your request at least 24 hours in advance. Late reschedule requests will result in the loss of that consultation without a refund.
  4. Arriving late may result in a shortened or cancelled appointment. No refund or additional appointment will be offered in this case.

Withdrawal and Cancellation

Right to Cancel - Within 14 Days of Purchase

You may cancel this contract within 14 days without giving a reason, provided that the MB Dietetics programme has not yet commenced (e.g., no consultations have occurred). To cancel, notify us via email at hello@mbdietetics.com before the 14-day period expires.

Commencement of Services During the Cancellation Period

Services will not begin during the 14-day cancellation period unless you explicitly request this. Booking an initial appointment within this timeframe will be considered as waiving your Right to Cancel.

Effects of Cancellation During the Cancellation Period

  • If no services have commenced, all payments will be reimbursed.
  • If services have begun at your express request, you will be charged proportionally for the services provided. For example, the cost of a 90-minute initial appointment is £285.

Right to Cancel - Outside the 14-Day Period

  • If you terminate the agreement after the 14-day period and more than two sessions have been provided, no refund, credit, or similar will be issued for incomplete services.
  • Outstanding payments for the programme must still be completed.
  • In exceptional circumstances (e.g., serious illness), programmes may be paused for up to three months at MB Dietetics' discretion.

Excluding Liability

  1. MB Dietetics does not exclude liability for:
    • Fraudulent acts or omissions.
    • Death or personal injury caused by negligence.
  2. We are not liable for:
    • Losses that were not reasonably foreseeable at the time of contract formation.
    • Business-related losses, as services are assumed to be for personal use.

MB Dietetics provides nutritional and lifestyle advice based on scientific evidence but cannot guarantee specific outcomes. Programme fees are for professional expertise and time; therefore, refunds are not issued for services rendered.

Governing Law and Complaints

This contract is governed by the laws of England and Wales. Disputes are subject to the jurisdiction of the courts of England and Wales, or those of Scotland or Northern Ireland, depending on your location.

We aim to resolve complaints amicably. If you have concerns, please contact us, and we will respond with a solution within 5 business days.
